Biden Orders Limits on Drone Strikes Outside ‘Conventional War Zones’

Biden Orders Limits on Drone Strikes Outside 'Conventional War Zones'

By Charles Kim | Friday, 07 October 2022 06:27 PM EDT

President Joe Biden signed a classified policy Friday that limits the use of drones for counterterrorism strikes outside of "conventional war zones," The New York Times reports.

According to the report, which cites an anonymous "senior administration official," the new policy restrictions were sent to the Pentagon and CIA on Friday that seeks to lower the number of strikes and requires Biden approve of any names added to a "list" of targets that could be in the crosshairs of "direct action."

Since taking office in January 2021, Biden has moved to limit drone strikes overseas, tightening up limits in effect during the administration of former President Donald Trump, who gave commanders in the field more discretion in using the strikes, moving back to more centralized control as it was during former President Barack Obama's tenure.

The Washington Post reported in September 2021 that while previous administrations were operating from a more "blanket authorization" policy, he sought to "rebalance" war powers between the executive and legislative branches of government.

"At the beginning of the administration, President Biden established new interim guidance concerning the United States' use of military force and related national security operations," The Post reported National Security Council spokeswoman Emily Horne saying at the time.

In 2019, The Post reported that 120 civilians were killed in drone strikes in the previous year, and a Director of National Intelligence report showed 473 strikes during Obama's administration killing around 2,500 "combatants" and 100 civilians between January 2009 and December 2015.

That report included only the number of strikes "outside" actively hostile areas such as Syria, Afghanistan and Iraq.

The new restrictions are also in line with previous rule changes Biden made in March 2021 that set the rules for such strikes and commando raids in some conflict zones, U.S. News and World reported at the time.

Department of Defense spokesman John Kirby said at the time that the "interim guidance" was given "to ensure the president has full visibility on proposed, significant actions, which the National Security Council will review."

"It's too early to come to grips with what reality is going to be, or the impact it's going to have on specific parts of the world or on specific terrorist groups," Kirby said in the report at the time. "It's interim. It's not meant to be permanent, and it doesn't mean it's a cessation" of these strikes or missions, he added. "The authorities in some parts of the world are going to get visibility at the National Security Council."

A Federal Appeals Court has ruled against an Obama-era immigration policy that protects “DREAMers.”

On Wednesday, a three-judge panel in New Orleans, Louisiana ruled that the Deferred Action for Childhood Arrivals (DACA) program violates federal law. The court affirmed a 2021 ruling by a Texas district court.

The DACA program provides administrative reliefs and deportation protection to immigrants who entered the United States unlawfully as children. Those in the program can apply for a driver’s license, social security number and work permits, as opposed to a legal path of citizenship.

The Texas ruling stated the program was a case of presidential authority overreach due to Congress not giving the executive branch the power to grant mass reprieves to “DREAMers.”
To note, the court did not cancel the program for current recipients. The program is allowed to remain as is but it cannot receive new applications while it is under review.

New Trump-aligned PAC Targets Pennsylvania, Ohio Senate Races

New Trump-aligned PAC Targets Pennsylvania, Ohio Senate Races (Newsmax)

By Luca Cacciatore | Friday, 07 October 2022 05:00 PM EDT

Two new advertisements by Make America Great Again, Inc. aim at the opponents of former President Donald Trump-backed Dr. Mehmet Oz in Pennsylvania and J.D. Vance in Ohio.

The political action committee, linked to top Trump allies, was founded on Sept. 23 to complement the existing Save America PAC. It will also likely serve as the former president's primary vehicle for spending money ahead of the November midterm elections.

On Friday morning, the first glimpse of what the group has to offer was made public with an advertisement tearing into Oz's Democrat rival for U.S. Senate, Pennsylvania Lt. Gov. John Fetterman.

The ad brings to light the story of John Brookins, a man currently serving a life sentence for murdering his then-girlfriend's mother with a pair of scissors. Recently, a movement has pushed for Brookins' release, alleging that new DNA evidence can clear him of the crime.

But Fetterman was the only member of Pennsylvania's Board of Pardons to vote for his clemency last year based on those claims, despite admitting to the Bucks County Courier Times that his "testimony wasn't particularly strong."

"John Fetterman wants ruthless killers, muggers, and rapists back on our streets. And he wants them back now," the ad states. "John Fetterman is dangerous."

Shortly after, the group released another ad highlighting a blunder by Ohio Democrat Rep. Tim Ryan, who is currently running against Vance for the U.S. Senate.

Taking specific aim at the congressman's perceived image as being a "moderate," the ad highlights Ryan's voting record and a comment made earlier this year when he said he's "got to suck up" to his "future boss," Senate Majority Leader Chuck Schumer, D-N.Y.

"Tim Ryan voted the liberal party line 100% of the time — giving stimulus checks to illegal immigrants, hitting middle-class families with tax hikes, creating sky-high inflation, [and] driving our economy to the brink of recession," MAGA Inc. claims.

Hayek: Women Will Rightfully Reject Left’s Anti-Woman Agenda

Hayek: Women Will Rightfully Reject Left's Anti-Woman Agenda anti-woman agenda of the left (Artem Stepanov/Dreamstime.com)

By Ashley Hayek | Friday, 07 October 2022 02:34 PM EDT

At a recent event, a local media reporter asked gubernatorial candidate Kari Lake her stance on abortion — a purportedly "taboo" topic for conservatives since the reversal, by the U.S. Supreme Court, of Roe v. Wade, 410 U.S. 113 (1973) with its decision in Dobbs v. Jackson Women's Health Organization.

Kari’s response was quick, "Let me tell you where Katie Hobb stands. She supports abortion up until birth and after birth. She supports if a baby survives a botched abortion, that the baby die on a cold metal tray."

Kari Lake isn’t wrong. Late-term taxpayer-funded abortion — carried out when a baby can feel pain and distress — is championed by the radical left.

They push on-demand abortions rather than innovative solutions that support women in fulfilling their greatest potential as mothers, or providing the necessary support to pursue options such as adoption or foster care.

These lawmakers, as well as celebrities, advocate for abortion on demand and perpetuate the notion that women cannot fulfill their professional aspirations if they allow motherhood to get in the way.

Growing up, my generation was taught that women were meant to shatter glass ceilings, to "lean in" and take their seat at the table.

Women can have it all!

But today, we are experiencing a different kind of reality where the strong, pro-woman movement is under attack. As a woman, the unique qualities contributing to and perpetuating life are being stripped away.

As a parent, it's a fight to protect our children physically and figuratively.

The Biden administration, which has been empowered by the radical left, has waged war on women and families.

As a millennial mom of five young children — four girls and one boy — let me share with you exactly what this means:

My daughters might have to compete physically against biological males.

If you are uncomfortable with that insane possibility, you will be labeled a bigot by the radical left. But it’s bigger than this. It’s the invasion of a woman’s — or a girl’s — privacy in restrooms, locker rooms, classrooms, and beyond.

Our children are being sexualized in the classroom with an agenda created by the national teachers’ unions and reinforced by extreme-left school board members.

This includes being exposed to transgender literature and a radical agenda, to secretly transition children without the parent’s knowledge or consent.

As parents demand answers from these school boards, they along with the national teachers’ union label parents "domestic terrorists."

It’s frightening what a self-assured, narcissistic political movement can do.

For a movement long focused on gender, the left now refuses to acknowledge what a woman even is.

On the second day of her confirmation hearings, U.S. Supreme Court Justice-nominee Ketanji Brown Jackson repeatedly declined to offer a definition of "woman."

Instead, our special, God-given identity is reduced to terms like "chest feeders" and "birthing persons."

It's almost as though the radical left prefers to strip away the dignity of life and the beauty of feminism in an attempt to devalue life itself.

It’s tough enough now for American women.

In recent months, the cost of living has increased by more than 30%.

Imagine single mothers out there; what opportunities are they able to pursue?

Who in Washington, D.C., looks out for them?!

With respectg to the formula crisis, instead of finding a solution, the Biden administration told moms to "call your pediatrician."

Yet, the Biden administration prioritized formula to be sent to the border.

Crime rates are skyrocketing, and the left is making petty theft immune from prosecution.

Giant corporations aren’t feeling that hit; make no mistake — this is a directed attack on small businesses, of which 12 million are women-owned.

Fentanyl is flooding through our borders and is now the leading cause of death among young Americans, harming American families.

According to the America First Policy Institute, annual drug overdoses topped 100,000 for the first time last year.

It’s quite simple, President Biden and the radical left have warped The American Dream into this country’s nightmare.

Americans need to demand answers:

  1. Is it OK to sexualize children?
  2. Is it OK to allow abortion in the 7th, 8th, or even 9th month when a baby can experience pain and distress?
  3. Is it OK to keep our borders open, allowing human trafficking and drugs to flow into our neighborhoods?
  4. Is it OK for our communities to be terrorized because many on the left want to defund law enforcement?

Women will define the future of our country.

We deserve respect and acknowledgment that who we are matters and is valued.

But we also deserve answers, and it is our responsibility to ensure we support leaders who honor women, families, and children. Demanding answers and enforcing accountability is how we save America.

Dick Morris to Newsmax: Biden Trying to ‘Wag the Dog’ With Nuke Warning

Dick Morris to Newsmax: Biden Trying to 'Wag the Dog' With Nuke Warning (Newsmax/"National Report")

By Sandy Fitzgerald | Friday, 07 October 2022 01:29 PM EDT

President Joe Biden is going for an "October surprise" with an attempt to "wag the dog" by warning about a "nuclear Armageddon," to distract Americans from problems at home under his administration, political analyst and author Dick Morris said on Newsmax Friday.

"Well, it's Halloween, so the October surprise is right here," Morris, the author of "The Return: Trump's Big 2024 Comeback," said on Newsmax's "National Report," I warned about this in my book and I've been amplifying it on your show and other shows for the last week or two."

Biden on Thursday, speaking at a fundraiser for the Democratic Senatorial Campaign Committee, said the risk of nuclear "Armageddon" is at the highest level since the 1962 Cuban Missile Crisis and that Russian President Vladimir Putin is "not joking when he talks about the use of tactical nuclear weapons or biological or chemical weapons."

"I predict in this book that he's going to wag the dog," Morris said Friday. "He's going to try to distract attention from inflation and the problems we have by warning about nuclear weapons in Russia."

Morris acknowledged that Biden's warnings "may be legitimate," but the timing shows that "he's trying to do this to jam the election message so nobody pays attention to inflation or the border."

Note: Get Dick Morris' new book "The Return" on Trump's secret plan for 2024. See It Here!

Meanwhile, Morris said that there was an "enormous" action during Thursday night's debates in Arizona, where Democrat Sen. Mark Kelly squared off against his GOP challenger, Blake Masters, with Masters "massively" winning the showdown.

"It was unbelievable and particularly interesting that Masters won the argument about abortion," said Morris. "It's the first time in this campaign that a Republican has effectively answered those attacks."

Morris said that Masters argued that he supports Arizona's law on abortion, which does allow the procedure up to 15 weeks of pregnancy, which "answers the arguments of the Democrats" who say Republicans are the extremists on abortion.

Democrats, though, favor abortion up to the 40th week, Masters argued, leaving Kelly with "nothing to say," said Morris. "It was the most amazing wipeout."

Morris said to remember that three races will determine the outcome of the Senator GOP majority, and he used the acronym "MOW" to describe them, meaning the majority depends on Masters, Dr. Mehmet Oz in Pennsylvania, and Herschel Walker in Georgia.

Sen. Grassley Will Not Support Graham’s 15-Week Abortion Ban

Sen. Grassley Will Not Support Graham's 15-Week Abortion Ban (Newsmax)

By Charlie McCarthy | Friday, 07 October 2022 01:10 PM EDT

Iowa GOP Sen. Chuck Grassley said he would vote against a bill calling for a national 15-week abortion ban.

Sen. Lindsey Graham, R-S.C. last month introduced legislation that would impose a national 15-week ban on abortions.

During a televised debate with Democrat opponent Mike Franken on Thursday night, Grassley was asked whether he supported Graham's bill.

"I would vote no," said Grassley, who last year co-sponsored Graham's bill that banned abortions after 20 weeks.

In the wake of the Supreme Court, in Dobbs v. Jackson Women's Health Organization, striking down the constitutional right to an abortion, Grassley said the issue should be handled at the state level.

Grassley, seeking an eighth term, led Franken, a retired Navy admiral, 47% to 39%, according to a Des Moines Register/Mediacom Iowa Poll conducted in July.

"That margin is narrower than in any Iowa Poll matchup involving Grassley since he was first elected to the U.S. Senate in 1980," the Register reported.

Although former President Barack Obama carried Iowa in both 2008 and 2012, the state voted for Donald Trump in 2016 and 2020.

Only nine Senate Republicans have sponsored Graham's proposal of a 15-week abortion ban, except when the life of the mother is at risk or in cases of rape or incest, The Hill reported.

In January, 2021, 43 Senate GOP members co-sponsored Graham's 20-week abortion ban bill.

Graham introduced his 15-week ban without consulting with Senate Minority Leader Mitch McConnell, R-Ky. — who wasn't thrilled at not being given a heads up, The Hill said.

The South Carolina senator's move shifted attention to the abortion debate from inflation, crime, and the southern border.

Last month, McConnell signaled that he does not plan to bring Graham's bill to the floor even if Republicans win back the Senate majority.

"With regard to his bill, you'll have to ask him about it. In terms of scheduling, I think most of the members of my conference prefer that this be dealt with at the state level," McConnell told reporters, The Hill reported.

Democrat strategist Brad Bannon insisted to the Washington Examiner that Graham's bill is "political suicide for the GOP, [because] it's clear in polling that the Dobbs decision drove many young people and women away towards the Democratic Party in the midterms."

MAGA Inc Senate Ads Running in Pennsylvania, Ohio

By Charlie McCarthy | Friday, 07 October 2022 12:20 PM EDT

A PAC sanctioned by former President Donald Trump launched video ads for U.S. Senate races in Pennsylvania and Ohio.

The Pennsylvania ad targets Lt. Gov. John Fetterman, who's in a tight race against Republican Mehmet Oz.

MAGA Inc.'s new ad, which was tweeted Thursday night by Save America Director of Communications Taylor Budowich, focuses on Fetterman casting the only vote in favor of clemency for man convicted of murder.

"He brutally murdered his girlfriend's mother with a pair of scissors. Convicted of first-degree murder, John Brookins is serving a life sentence. John Fetterman was the only member of the pardon board to vote for Brookins' release — the only vote," a speaker says in the video ad.

"John Fetterman wants ruthless killers, muggers, and rapists back on our streets, and he wants them back now. John Fetterman is dangerous."

Meanwhile, Republican J.D. Vance is trying to defeat Rep. Tim Ryan, D-Ohio, and succeed retiring Sen. Rob Portman, R-Ohio.

The Washington Free Beacon's Joe Gabriel Simonson on Friday tweeted a "first look" at the MAGA Inc. video ad, which begins by showing Ryan at an event attended by Senate Majority Leader Chuck Schumer, D-N.Y.

"'Sen. Schumer's here and I want to make sure he's my future boss so I gotta such up a little bit here,'" Ryan says before a voiceover speaker is heard.

"Tim Ryan voted the liberal party line 100% of the time. Giving stimulus checks to illegal immigrants. Hitting middle-class families with tax hikes, Creating sky-high inflation. Driving our economy to the brink of recession. 'I gotta suck up a little bit here.' Did he ever."

AdImpact Politics tweeted Thursday that MAGA Inc., sanctioned by Trump, began its campaign spending by placing broadcast reservations in Ohio with $276,000 in Columbus and Cleveland.

Budowich, a former senior adviser on Trump's 2020 campaign, oversees MAGA Inc., Politico reported. Longtime Republican operative Chris LaCivita, who previously ran the pro-Trump super PAC Preserve America, will be chief strategist.

"President Trump is committed to saving America, and Make America Great Again, Inc., will ensure that is achieved at the ballot box in November and beyond," Budowich told Politico last month.

NYT: DOJ Said to Suspect Trump Has Additional Documents

NYT: DOJ Said to Suspect Trump Has Additional Documents (Newsmax)

By Jeffrey Rodack | Friday, 07 October 2022 10:03 AM EDT

Jay Bratt, who heads the Justice Department's counter Intelligence operations told lawyers for Donald Trump in recent weeks that the DOJ believes the former president has not returned all the documents he took when he left the White House, The New York Times is reporting.

The newspaper attributed the information to two people briefed on the matter.

It is unknown whether DOJ has uncovered any new evidence that Trump is in possession of additional documents even after the FBI raid on his South Florida estate in August. And it remains unclear what steps, if any, DOJ officials might take to get back the additional material — if it does exist. The Justice Department declined to comment.

The FBI seized a combination of government, business, and personal documents when agents raided former President Donald Trump's Mar-a-Lago home, a recently unsealed court filing showed.

Thousands of documents included analysis about pardon requests, call notes marked with a presidential seal, and retainer agreements for lawyers and accountants, Bloomberg reported, based on a recently unsealed Aug. 30 report from the Justice Department.

N.H. Candidate Leavitt to Newsmax: Youth ‘Greatest Asset’ in House Race

N.H. Candidate Leavitt to Newsmax: Youth 'Greatest Asset' in House Race karoline leavitt smiling Karoline Leavitt (AP)

By Sandy Fitzgerald | Friday, 07 October 2022 09:46 AM EDT

Karoline Leavitt, the 25-year-old New Hampshire GOP candidate seeking election to the U.S. House of Representatives, is often attacked by her opponent because of her age, but Leavitt said on Newsmax on Friday that her youth is her "greatest asset," as voters in the state's 1st Congressional District "want a fresh voice."

"It's funny because my opponents try to use it as our greatest weakness," Leavitt told Newsmax's "Wake Up America," adding that people in her district "want youthful energy down in Washington, D.C., to shake up the system."

Leavitt could be the youngest woman elected to Congress, coming in at four years younger than Rep. Alexandria Ocasio-Cortez, D-N.Y., who was 29 when she was sworn in.

Leavitt, a 2019 graduate of Saint Anselm College in New Hampshire, worked in former President Donald Trump's administration just after graduating and became an assistant press secretary under Kayleigh McEnany, reports CNN. After Trump left office, Leavitt worked for Rep. Elise Stefanik, R-N.Y., who was once the youngest woman elected to Congress, taking office in 2014 at 30.

Leavitt is challenging incumbent Democrat Rep. Christopher Pappas, who was sworn into office in 2019.

Leavitt told Newsmax that some have been in Congress "twice as long as I have been alive, clinging to power and ripping off hardworking families like my own. That's why I got involved in this race in the first place."

Leavitt also said that young voices need to be elected, because "Generation Z [is] unfortunately being taught socialism and cultural marxism by the left."

"It's in every institution in this country, starting in our public schools, higher education universities, the mainstream media, tech, Hollywood, you name it," said Leavitt. "It's indoctrinating my generation, and we desperately need a young conservative voice to wake up these voters. So not only can we win elections, but we can save our country as well."

Leavitt also discussed the issues facing her state and said that the main concern is with the rising cost of energy.

"We have some of the highest electricity rates of any state in the country," said Leavitt. "We're a cold weather state, and this winter, we're facing a home heating oil shortage, which is a very dangerous and scary reality.

"I'm talking to mothers and fathers who are choosing between feeding their children eating and heating this winter, and it's a direct result of the policies of the Biden administration that my Democratic opponent, Chris Pappas, has supported 100% of the time."

But Pappas says he pushed the Biden administration into tapping into the federal oil energy reserves, said Leavitt, and she called that a mistake.

"We've nearly depleted those emergency reserves," she said. "Those are supposed to be used for war time."

Levitt also on Friday discussed the fentanyl crisis, saying it's one of the top issues facing her state and is becoming worse because of the Biden administration's "wide open border policies."

"The fentanyl crisis has hit us hard for nearly a decade," said Leavitt. "I know way too many people, unfortunately, that have lost their lives to drug addiction, and we have a real problem, and it's only gotten worse because of the wide-open border policies of this administration.

"I'm proud to be supported by the New Hampshire Police Association and several sheriffs within my district, because they know I will fight to shut down the border and stop this influx of drugs."

Trump Mocks ‘Liddle Ben Sasse’

Former President Donald Trump ridiculed Sen. Ben Sasse after reports emerged that the Nebraska Republican is expected to resign from the Senate by the end of the year to head the University of Florida.

Trump’s comments came in a pair of posts on Truth Social.

He wrote: “Great news for the United States Senate, and our Country itself. Liddle’ Ben Sasse, the lightweight Senator from the great State of Nebraska, will be resigning. If he knew he was going to resign so early in his term, why did he run in the first place? But it’s still great news! The University of Florida will soon regret their decision to hire him as their President."

And he added: “We have enough weak and ineffective RINOs in our midst. I look forward to working with the terrific Republican Party of Nebraska to get a REAL Senator to represent the incredible People of that State, not another Fake RINO!”

RINO is short for “Republican In Name Only.”

Sasse was one of seven Republican senators to vote for Trump’s impeachment in 2021.

KFAB talk radio host Ian Swanson reported on Thursday that Sasse "will imminently announce his intent to resign from the U.S. Senate to pursue another opportunity in higher education. While the process could take a bit, the announcements are expected 'imminently.'"

Swanson also said he was "told to expect the resignation to actually be made official in December.”

The "University of Florida announced Sasse as the sole finalist to be the 13th president of the UF System," Swanson added. "His resignation would be made official upon confirmation by the Board of Trustees, likely in December.”

The Washington Examiner noted that, should Sasse follow through with his resignation and announce it in December, Nebraska Gov. Pete Ricketts is expected to name a replacement.

Should Sasse announce his resignation in January or later, a new governor will name the replacement.

Bill O’Reilly to Newsmax: GOP-Led House Might Impeach Biden

Bill O'Reilly to Newsmax: GOP-Led House Might Impeach Biden (Newsmax/"Rob Schmitt Tonight")

By Eric Mack | Thursday, 06 October 2022 09:04 PM EDT

While the reports of alleged evidence significant enough to charge Hunter Biden with federal crimes do not implicate President Joe Biden, political pundit Bill O'Reilly on Newsmax said a Republican-led House might make that connection in their oversight and ultimately impeach the president.

"If the House committees investigating Hunter Biden-Joe Biden financial situation come across documents that show that Joe Biden himself received money, that's impeachment," O'Reilly told Thursday's "Rob Schmitt Tonight." "That's impeachment. He's out.

"None of this is good news for Joe Biden," O'Reilly said, adding, and "he knows it."

O'Reilly began his appearance with host Rob Schmitt denouncing Biden's effort to get Saudi Arabia to pump more oil for America, only to have the opposite happen.

"The Biden administration's beyond incompetent — I think everybody understands that at this point," O'Reilly said, noting the OPEC+ oil alliance will ultimately hold the U.S. up for ransom on oil. "But the U.S. can't cut arms shipments to Saudi Arabia because they're the bulwark against Iran. So all of this is just posturing. It's just blowing smoke.

"The Arabs always try to squeeze the USA. It's been going on for what, 78 years? But the Biden administration's windmill thing didn't work. The electric car thing didn't work. They shut down the fossil fuel industry, or try to, in the USA. It led to inflation."

O'Reilly admits Biden will not be leaving the White House before 2024, but Republicans can start to move the country back into a conservative direction if they retake control of the House and Senate.

"We've got to put up with this guy for another two years, but I hope in the midterms that people say, 'Enough, enough, enough,'" O'Reilly said.

Former President Donald Trump had workable relations with Saudi Arabia, and they would not have played Trump like they have Biden, O'Reilly concluded.

"They knew if they did stuff like this, embarrassing the U.S., or making it more difficult, that Trump would find a way to hurt them, but nobody's afraid of Joe Biden," he said.

Alan Dershowitz to Newsmax: Trump 'Most Interested' Hunter Is Not Charged

(Newsmax/"The Record With Greta Van Susteren")

By Eric Mack | Thursday, 06 October 2022 08:31 PM EDT

Amid reports federal agents allegedly have enough to charge Hunter Biden with tax and gun crimes, legal expert Alan Dershowitz on Newsmax said former President Donald Trump should be rooting for no charges from Attorney General Merrick Garland.

"I'll tell you the man who should be most interested in assuring that Biden does not get prosecuted, and it's not Joe Biden: It's Donald Trump," Dershowitz told Thursday's "The Record With Greta Van Susteren." "Let me explain why; it's counterintuitive: Unless they indict Biden Jr., they will not credibly be able to indict Trump.

"But if they indict Biden Jr., Garland will be able to say, 'Look how fair we are: We didn't go after Trump; we indicted the son of the president and we indicted the man who's going to be running against the president.'

"Fair is fair, and that's why politics inevitably plays a role in this, because in all of these cases, there's an element of subjectivity."

Van Susteren noted in 2018, when the Hunter Biden investigation reportedly began, there was close to a 60% prosecution rate on criminal referrals for lying on gun forms — as Hunter Biden is alleged to have done because of admitted drug use.

"Look, I hate the fact that we just weaponized the criminal justice system on both sides, and I think we're seeing this as an example," Dershowitz said. "I think the defense attorney was right when he said the only reason that they're going after this guy [is] because of his last name. I don't think they would generally do that. On the other hand, if the facts make out a clear case of criminal violation, and they, you know, obviously have to go for it."

But, Dershowitz added, prosecution might depend on finding "willfulness" to commit an alleged crime.

"Did he make the 'to be or not to be' decision, from Hamlet: to be or not to be a felon?" Dershowitz asked. "Do I deliberately lie to get a gun license, knowing full well that I'm using drugs, or is it just slippage? The same thing with income taxes? There are a lot of bad income tax returns filed but never prosecution because blame it on the accountant.

"In order to get a prosecution here, you have to show willfulness to a high level of certainty," Dershowitz continued. "You have to show that this man set out to commit crime — not that it was negligent, not that it was careless, not even that it was reckless — and I just don't know if you ever come up to that standard."

There is a clear political conundrum here, too, according to Dershowitz.

"Even though every case should be considered separately, when you have the son of the current president under investigation and the potential future candidate for president against the incumbent under investigation, there is no way that some degree of politics, some degree of balance won't be used by the Justice Department," he said.

"But, it will ultimately come to Garland's desk and the buck stops there, and he has to make a very, very difficult decision, but I don't think we're going to see one of them prosecuted and the other not. I think if one gets prosecuted, it raises the likelihood that the other will be prosecuted."

Ultimately, Thursday's reports by The Washington Post and The New York Times raise the question of whether the leaks about evidence against Hunter Biden might have been felonious.

"I don't like leaks of grand jury material," Dershowitz concluded. "I think there ought to be an investigation of how The Post and The Times got this story. Did they get it from an FBI agent who feloniously disclosed grand jury material? That's a serious crime."

Devin Nunes to Newsmax: ‘You Have to Go With What Works’ in Energy

Devin Nunes to Newsmax: 'You Have to Go With What Works' in Energy (Newsmax/"The Chris Salcedo Show")

By Nicole Wells | Thursday, 06 October 2022 07:17 PM EDT

Former California congressman Devin Nunes told Newsmax Thursday that Saudi Arabia doesn't see the U.S. as a "reliable partner at this point," which is why the kingdom is backing massive cuts to OPEC's oil output, and that, until green energy delivers, "you have to go with what works."

"They saw what happened, after 40-50 years of working closely with the United States of America, what the democratic socialist party did in this country, and I think the Saudis want nothing to do with it," Nunes, CEO of Trump Media & Technology Group, said during an appearance on Newsmax's "The Chris Salcedo Show." "I think, if you're the Saudi Arabian government, they don't see the United States as a reliable partner at this point, so they're like, hey, we're going to do what's best for us."

Nunes said that the Democrats, and President Joe Biden specifically, were "very critical" of the Saudi regime in the past.

"There are dictators all around the world," he said. "They are bad, they do a lot of bad things, but we have had a great relationship with the Saudi kingdom for decades."

"For the Democrats to demagogue them and attack them over and over and over again, and then, all of a sudden, they decide to implement their climate hysteria [and] their worshiping of the green gods, and essentially shut down pipelines, construction for oil and gas in this country, shut down new drilling, and miraculously believe that we're going to import enough windmills and solar panels from China to solve this problem," Nunes continued. "Then, when it doesn't work, then you run back over to Saudi Arabia."

In Nunes's home state of California, he said the Democrats' green energy agenda isn't delivering as anticipated.

"We put in so many solar panels that when the sun goes down, we don't have enough power," the Golden State resident said. "We found that out earlier this year, just a month ago or so. Plus … I think we're the highest price for electricity."

"So, since we've been investing in the so-called green energy, all that's happened is that electricity prices have tripled or quadrupled in the state of California," he continued. "I think Republicans, conservatives, have been for an all-of-the-above strategy, but it relies on what is most important and that is, until there truly is this type of green energy that works, you have to go with what works."

Elaborating on "what works," Nunes said that the U.S., which was a net exporter of energy under the Trump administration, has an oil pipeline "sitting up in Alaska that's running at 15% or 20%."

"We're not even using it, even though it's one of the largest oil reserves in the country," he said. "The Trump administration opened it up. The Biden administration closed it back down."

Trump Allies Launch Senate Ad Campaign

Trump Allies Launch Senate Ad Campaign (Newsmax)

By Theodore Bunker | Thursday, 06 October 2022 03:51 PM EDT

Allies of former President Donald Trump launched a new ad campaign in support of Republican Senate candidates through a recently created super PAC, according to AdImpact.

Politico notes that MAGA Inc., is being overseen by Trump spokesperson Taylor Budowich, a former senior advisor on Trump's 2020 campaign. Longtime Republican operative Chris LaCivita, who previously ran the pro-Trump super PAC Preserve America, will be chief strategist.

"President Trump is committed to saving America, and Make America Great Again, Inc. will ensure that is achieved at the ballot box in November and beyond," Budowich told Politico.

The organization spent $276,000 on TV ad time starting Friday in Ohio markets Columbus and Cleveland in a potential attempt to bolster the campaign of GOP Senate nominee J.D. Vance before the midterm elections. It also spent $135,650 on ads in Pittsburgh, Pennsylvania, where Republican Mehmet Oz is running for Senate against Democrat Lt. Gov. John Fetterman.

"We don’t telegraph ad spends or our strategy," said a spokesperson for MAGA Inc. told Politico.

Feds Believe They Have Enough to Charge Hunter Biden With Tax, Gun Crimes

Feds Believe They Have Enough to Charge Hunter Biden With Tax, Gun Crimes

(Newsmax/"Rob Schmitt Tonight")

By Sandy Fitzgerald | Thursday, 06 October 2022 03:57 PM EDT

Federal investigators believe they have sufficient evidence to charge President Joe Biden's son Hunter with tax crimes and making a false statement about a gun purchase, and now it's up to a Delaware U.S. attorney, who was nominated by then-President Donald Trump, to take the next steps, according to sources close to the case.

The reports come years after the investigation into the president's son began in 2018 initially centering around his finances about his work overseas, such as with the Ukraine energy giant Burisma, but have shifted to whether he failed to report his income and if he lied on his paperwork in 2018 about whether he was a drug user when buying a gun, reports The Washington Post, quoting anonymous sources.

The case is in the hands of U.S. Attorney David Weiss in Delaware, whom Trump nominated in 2017, while Attorney General Merrick Garland says there will be no political pressure in the case.

Weiss' spokeswoman declined to comment, as did the Department of Justice, the FBI and the IRS, but Hunter Biden's attorney Chris Clark accused federal investigators of leaking the information on the investigation.

"It is a federal felony for a federal agent to leak information about a grand jury investigation such as this one," he said in a written statement. "Any agent you cite as a source in your article apparently has committed such a felony. We expect the Department of Justice will diligently investigate and prosecute such bad actors."

Further, Clark wrote that the Biden team believes the prosecutors in the case are weighing not only the evidence from the investigators but from all other witnesses and "should not be pressured, rushed or criticized for doing their job."

A decision to charge Biden with crimes will have political ramifications, considering Trump and his allies have used accusations of corruption in his business dealings to attack Democrats, before and after his father won the 2020 election.

The primary focus of the tax investigation has been whether Hunter Biden did not declare income related to his various business ventures, including those overseas.

During the 2020 race, Trump's allies revealed Biden's laptop had been turned over to the FBI after he left it at a Delaware computer repair shop.

By December of that year, federal agents sought an interview with Biden, and he publicly acknowledged he was under investigation, but said he was confident that a review would show he handled his affairs "legally and appropriately."

But Thursday, his attorney said he's had no contact with any federal investigative agents.

"A rendition of the case from such an 'agent' is inherently biased, one-sided and inaccurate," he said. "It is regrettable that law enforcement agents appear to be violating the law to prejudice a case against a person who is a target simply because of his family name."
